Section 16A of the RTA, requires private landlords to appoint an agent to manage their property before they leave the country for more than 21 days. The agent can be any trusted individual based in New Zealand, not necessarily a property manager, but they must be prepared to fulfill the role's responsibilities.
A landlord who fails to appoint an agent and comply with this section of the RTA; commits an unlawful act with penalties up to $1500 payable to the tenant.
While any individual based in New Zealand can act as your representative, they need to be well-informed of tenancy obligations to manage the property effectively. Choosing a knowledgeable and reliable property manager provides peace of mind, ensuring your property and tenants are in good hands.
The landlord must give the tenant the agent’s name, contact details, and address for service. If these details aren’t provided, tenants may issue a notice to remedy, urging landlords to comply with their responsibilities.
