Going overseas? Here's what New Zealand landlords need to know.

With the festive season and summer holidays fast approaching, many New Zealanders are preparing to head overseas to visit family or enjoy a well deserved break. If you self-manage your rental property, it’s important to know that once you’re out of the country for more than 21 consecutive days, the Residential Tenancies Act requires you to appoint a New Zealand–based agent — and understanding this now can make your time away far more relaxed and stress-free.

Your legal obligations under the Residential Tenancies Act

If you self-manage your rental property, Section 16A of the Residential Tenancies Act (RTA) requires you to appoint a New Zealand–based agent before leaving the country for more than 21 consecutive days.

This agent can be any trusted person based in New Zealand, though they must be willing and able to take on full landlord responsibilities while you’re away, from responding to maintenance issues to handling any tenancy matters.

Failing to appoint an agent is considered an unlawful act, with penalties of up to $1,500 payable to the tenant.

Who can act as your agent?

Legally, any trusted individual living in New Zealand can take on the role. However, acting as an agent is more than being “on call.” They must:

  • Understand the RTA and your ongoing obligations
  • Manage communication and issue resolution
  • Be available and responsive
  • Handle notices, disputes, and compliance requirements

For many landlords, assigning this responsibility to a friend or family member can be stressful, which is why a qualified property manager is often the best option and offers genuine peace of mind.

Keeping your tenant informed 

Before you travel, you must give your tenant:

  • Your appointed agent’s name
  • Contact details
  • An address for service

If this information isn’t provided, your tenant may issue a notice to remedy, requiring you to comply within a specific timeframe. Ignoring this notice is also an unlawful act under the RTA.
